Court upholds decision
November 5, 2007
A former student’s disorderly conduct conviction for going topless in the Bowling Green City Park was upheld by the 6th District Court of Appeals in Toledo.
Lorien Bourne, 36, organized a topless picnic at the City Park last September in protest of an indecent conduct and exposure charge she received for rollerblading topless down the Slippery Elm Bike Trail two months prior.
Bourne argued that if she was cited, the topless men in the park should also have been cited. There is a legal double standard between men and women, she said.
A three-judge panel at the 6th District Court of Appeals in Toledo reviewed Bourne’s case and ruled that she was not a victim of selective law enforcement and that female breasts are considered an erogenous zone.
