Ohio is among four states that will join 21 other states requiring age verification to access online pornography and other adult content thanks to a provision in the state’s two-year operating budget signed by Gov. Mike DeWine last month.
Adult websites will soon be required to confirm Ohio users are over 18 years old before granting them access to content deemed “obscene or harmful to juveniles.” The provision makes adult websites responsible for using technology to monitor the location of their visitors and ensuring visitors are of legal age. The law takes effect September 29.
According to NBC4i in Columbus, “users in Ohio will have to prove their age by uploading a copy of a government-issued photo ID or other personal identification, such as proof of a mortgage or employment. Purveyors of online pornography would be required to ‘immediately’ delete such documents after the verification is complete, unless a user maintains an account or subscription.”
Cleveland’s News 5 reports the law states “an establishment that is primarily centered on explicit content and makes a significant amount of money on said content will need to follow this law. However, others that host pornography may still be subject to the law.” The report indicates there is an explicit exemption for news organizations, cable, streaming providers and social media.
According to the Free Speech Coalition, 21 states have laws in effect that require age verification to access online pornography while Ohio, Missouri, Arizona and North Dakota will soon have those restrictions in place. The Coalition filed lawsuits against several states with verification laws but the U.S. Supreme Court ruled for Texas in June.
PornHub, the world’s most-visited adult website, and other adult websites, completely blocked access to regions with age-verification laws on the books.
